He was implicated in the robbery of Mrs. Melissa Kennedy, the mother of his brother-in-law Reuben Kennedy (his sister's husband). Reuben was bound, gagged, and left in a wagon during the robbery. The robbery occured at the home of Mrs. Kennedy, six miles south of Mexia, on 2 Sep 1935. She was a wealthy widow. She carried her money in a belt around her waist. The men, Cliff Davis, Joe Shamblin, and Felix Goss were arrested in Tyler, Texas, after a $500 bill cashed through the Federal Reserve Bank in Dallas was traced. Goss had $1700 on him at the time of his arrest. He said he had received a larger cut if he would take the large bill. He played poker and won more money, thus he had the larger amount on him. He made a complete statement. A fourth suspect was arrested after being chased from New Mexico to Winona, Mississippi where he was arrested at the home of a relative. That suspect signed a statement about the robbery. On 28 Oct 1936 he went to trial. Previous articles said the woman was robbed of $1400, but other articles about the trial said $4000. At the trial, sisters Ida and Pearl and brother Jim were among the witnesses. There were numerous character witnesses. Shamblin said among other things that he was not in the area at the time of the robbery, and that he had parked his car after he could not make his payments, but borrowed money to cover the back payments and a month's future payments, at which time he moved to another place in Tyler. Mrs. Kennedy said she pulled the mask from Joe's face, and that even if she had not seen it, she would have recognized his voice. Lester Love, one of the accused robbers, also testified that they had been involved in the crime. He was convicted and given five years, but it was discovered that one of the juror had been convicted of a felony and was not eligible to serve in that capacity. At the time of Felix Goss's trial two years later, Joe was at large. After the previous trial, he disappeared, and law officers had been searching for him.

His death certificate said he was divorced.
