He enlisted in the Republic of Texas army into the First Regiment of KY Volunteers, under Colonel Seguin, 1 Jun (hard to read, could be Jan) 1836. He was honorably discharged 4 Nov 1836. The discharge papers say that he was born in Boston, Massachusetts, he was 23 years of age, five foot eight inches, light complexion, blue eyes, and sandy hair. He was a private. (file 06400079) On the first of January of 1838, he enrolled in the Houston Volunteer Guard in Capt. Ross' Company. He served there for three months, and was honorably discharged. By that time he had dark complexion, dark hair, and dark eyes. He was described as a painter at the time of enrollment. He was discharged 2 Apr 1838. (file number 06400090, claim number 7645) In May he returned a horse to the Republic of Texas (file 06400091) Hostilities with Mexico continued. In September 1842 he was was a Texas Ranger. He was in San Antonio when the Mexican army took it for a brief time. He escaped. He was on the Mier expedition, taken prisoner 26 Dec 1842, and escaped from the hospital at Mier, Mexico. This was after the Texas War for Independence, during the Mexican American War, while he was a Texas Ranger. Refugia and her husband Rober Grier attempted to claim back wages and expenses for his military service in the Mexican American War and his service in the Texas Rangers. On 11 Oct 1858 he received an award of $127.25 for his services in Capt. Hays company in 1842. (file 17000215-17000216 of the Republic Claims.) This must have been paid to his widow Refugia. On 20 Dec 1858 Robert and Refugia acknowledge receipt of the funds. He died intestate in 1849 according to claims filed by his widow, Refugia Losoya Mallon, filed in Bexar county 28 Feb 1852. Robert Grier was the executor of the estate as requested by his widow, his next of kin. One paper in the series for the war claims lists Robert Grier as her husband (dated 21 Dec 1857). HIs widow apparently filed a claim 1 Sep 1851 for $605. Apparently it had something to do with a law to provide land for him since he received a disability for life in the service of his country: Joint Resolution for the relief of Theodore D. Maltby, John Hervey and Nathaniel R. Mallon, who were disabled for life in the service of the country. On 15 Aug 1854 there was a land transfer which showed Nathaniel Mallon as the original grantee. (Henderson County, abstract #494, Nacogdoches 1st Dist., File #795, James B. Shaw Patentee, patent #145, pat. vol. 11, cert. 879/978, 4605.50 acres) It appears that in 1855 creditors were allowed to cash in their debts for a cash settlement, so maybe that is the source of the money. More research needed. Could his parents be the following, listed on Rootsweb, Boston, MA marriage records? Considering the Rogers surname for the wife, it MUST be!
